According to the deal reached, an EU Carbon Border Adjustment Mechanism (CBAM) will be set up to equalise the price of carbon paid for EU products operating under the EU Emissions Trading System (ETS) and the one for imported goods. This will be achieved by obliging companies that import into the EU to purchase so-called CBAM certificates to pay the difference between the carbon price paid in the country of production and the price of carbon allowances in the EU ETS.
The new bill will be the first of its kind. It is designed to be in full compliance with World Trade Organisation (WTO) rules. It will apply from 1 October 2023 but with a transition period where the obligations of the importer shall be limited to reporting. To avoid double protection of EU industries, the length of the transition period and the full phase in of the CBAM will be linked to the phasing out of the free allowances under the ETS. This will be negotiated later this week in connection with the revision of the ETS and the results integrated into the CBAM regulation.

В конце сентября российские власти в ответ на европейские санкции до конца года запретили грузовикам из ЕС въезжать в Россию. Но в документе был перечень товаров, на которых запрет на ввоз не распространялся. И под это исключение подпадали, в частности, картон и бумага.
Но теперь Минтранс предлагает запретить их ввозить в страну на европейских грузовиках.

🛢📉 Так ли сильно снижается морской экспорт нефти из России?
Согласно данным Eikon по отслеживанию танкеров, в середине декабря ежедневные подтвержденные морские отгрузки нефти из РФ значительно снизились до среднего уровня 1,4 млн барр./сут. Однако после минимальных значений 14-16 декабря (0,6-0,7 млн барр./сут.) отгрузки начали восстанавливаться до 2,0 млн барр./сут. (19 декабря), но они все еще ниже начала декабря, когда отгрузки были на уровне 2,6-2,7 млн барр./сут.
Отгрузки российской нефти в Европу снизились до минимальных значений (по сути, остались только отгрузки российской нефти в Болгарию, для которой предусмотрено исключение в рамках эмбарго). Также в условиях неопределенности по правоприменительной практике ценового "потолка" временно приостановлены официальные танкерные поставки российской нефти в Турцию.
Сократились и официальные поставки в Индию и Китай, которые продолжают оставаться основными покупателями российской нефти, зато значительно выросли поставки нефти без указания конечного пункта назначения.
Однако не следует преждевременно посыпать голову пеплом, поскольку если это действительно так, то в российских портах должны были возникнуть проблемы с заполнением хранилищ, чего пока не наблюдается. Также мы пока не слышим о каком-либо затоваривании нефтебаз. Другими словами, возможно, российский нефтяной экспорт начал уходить в "серую" зону и использовать "теневой флот" по примеру Ирана? В этом случае официальные данные о движении танкеров с российской нефтью уже не будут в полной мере отражать реальную ситуацию с российским нефтяным экспортом.
Вместе с тем, пока недостаточно данных, чтобы подтвердить или опровергнуть это предположение, поэтому мы продолжаем следить за развитием событий. /IEFnotes

Президент России В.В. Путин подписал Указ 961 от 27.12.2022 "О применении специальных экономических мер в топливно-энергетической сфере в связи с установлением некоторыми иностранными государствами предельной цены на российские нефть и нефтепродукты".
Ключевой аспект Указа отражен в п.1. Запрещаются поставки российской нефти и нефтепродуктов иностранным лицам при условии, что в контрактах на эти поставки прямо или косвенно предусматривается использование механизма фиксации предельной цены.
Напомним, что нормы США, ЕС и ряда других стран "коалиции ценового порога" предусматривают запрет лицам в их юрисдикции перевозить российскую нефть морским путем, если цена контракта на ее покупку превышает ценовой порог. Сейчас он составляет 60 долларов США за баррель. Но может меняться по решению стран-инициаторов.
Интересно то, как именно норма будет работать на практике. Покупателю не обязательно указывать в контракте механизм ценового порога. Ведь на покупателя запреты не распространяются. Они бьют по перевозчику нефти. Перевозчик, в свою очередь, покупателем не является. Его задача - доставить. И если цена контракта выше порога, доставлять он не будет.
У покупателя проблема может возникнуть в том случае, если цена выше порога, и он попросту не получает свою нефть из-за проблем с перевозкой. Поэтому в реальности покупатель, вероятно, будет стараться оставаться в пределах порога, не оговаривая причин в контракте. Указ Президента пока не расшифровывает, что понимается под косвенным использованием механизма предельной цены. Предельная цена может быть ориентиром для покупателя по умолчанию.
В любом случае, чем меньше зависимость России от западных перевозчиков нефти и нефтепродуктов и провайдеров сопутствующих услуг (страхование и др.), тем в меньшей степени на Россию будет действовать ценовой порог.
