Реакция США на проигранный в ВТО спор по тарифам на сталь и алюминий. Пока решение доступно только по кейсам Китая, Норвегии, Швейцарии, Турции (#DS544, #DS552, #DS556, #DS564): United States — Certain Measures on Steel and Aluminium Products
В целом, как представляется, Третейская группа (ТГ) выбрала наиболее простой путь решения вопроса:
- США нарушили статьи I и II GATT (тарифы выше тех, что в US Schedule + дискриминация при предоставлении изъятий для отдельных стран);
- статья XXI GATT не защищает США, поскольку мера принималась “не в условиях войны или чрезвычайной ситуации в международных отношениях”.
Easy.
Сложнее было бы пойти через полноценный анализ статьи XIX GATT (safeguards) и всех элементов американской меры.
Но ТГ решила, что «мера принималась Штатами для защиты нацбезопасности, поэтому будем рассматривать её в свете статьи XXI GATT».
Иными словами: раз американцы назвали это нацбезопасностью, то поверим им на слово («вот, и в своих отчетах по стали и алюминию они же ссылаются на нацбезопасность 💁🏿♀️»), даже если сама мера по всем своим признакам похожа на спецзащитную.
Ну да ладно.
Больше, конечно, интересует, где отчеты ТГ по остальным кейсам по этому вопросу; и будет ли апелляция (в никуда)?

Indonesia has notified the Dispute Settlement Body of its decision to appeal the panel report in the case brought by the European Union in “Indonesia — Measures Relating to Raw Materials” (DS592). The panel report was circulated to WTO members on 30 November. The appeal was circulated to WTO members on 12 December.

According to the deal reached, an EU Carbon Border Adjustment Mechanism (CBAM) will be set up to equalise the price of carbon paid for EU products operating under the EU Emissions Trading System (ETS) and the one for imported goods. This will be achieved by obliging companies that import into the EU to purchase so-called CBAM certificates to pay the difference between the carbon price paid in the country of production and the price of carbon allowances in the EU ETS.
The new bill will be the first of its kind. It is designed to be in full compliance with World Trade Organisation (WTO) rules. It will apply from 1 October 2023 but with a transition period where the obligations of the importer shall be limited to reporting. To avoid double protection of EU industries, the length of the transition period and the full phase in of the CBAM will be linked to the phasing out of the free allowances under the ETS. This will be negotiated later this week in connection with the revision of the ETS and the results integrated into the CBAM regulation.

В конце сентября российские власти в ответ на европейские санкции до конца года запретили грузовикам из ЕС въезжать в Россию. Но в документе был перечень товаров, на которых запрет на ввоз не распространялся. И под это исключение подпадали, в частности, картон и бумага.
Но теперь Минтранс предлагает запретить их ввозить в страну на европейских грузовиках.
Как пишу «Ведомости», запрет коснется, в частности, изделий, которые используются для производства упаковки для продуктов питания. Об инициативе уже знают представители ассоциации поставщиков продуктов питания «Руспродсоюз», а также Ассоциации международных автомобильных перевозчиков. Если решение будет принято, это приведёт к увеличению сроков доставки упаковочных материалов и удорожанию их логистики.
