On the 10th of April, the Central District Military Court in Yekaterinburg carried out the sentencing of Roman Nasryev and Aleksei Nuriyev. Both young men were sentenced to nineteen years, four of which they will spend in prison, the remaining fifteen in a maximum-security penal colony.
This is the harshest sentence given to date for anti-war arson. The friends received such long sentences because their actions were classified under the articles for "terrorist acts" (Part 2 of Article 205 of the Russian Criminal Code) and "training for the purpose of committing terrorist activities" (Article 205.3 of the Russian Criminal Code). The second article carries a fifteen year minimum sentence.
The actual arson that Roman and Alexey committed, against the backdrop of the mobilization and in protest against the invasion of Ukraine, was rather symbolic: the woman on guard managed to put out the fire with a blanket and five litres of water. The only victims were a window and some linoleum.
Nasryev pleaded guilty to the charge of arson, but denied the charge of "terrorism", noting separately that he had not received "training to carry out terrorist activities". He drew the court's attention to the fact that anyone can throw a Molotov cocktail, and doing so requires no specialist knowledge.
Roman has two children at home, including a newborn son born while his father was in pre-trial detention. If Roman has to serve his entire sentence in custody, that son will be 19 years old by the time he gets released.
Roman Nasryev's lawyer has already filed a brief appeal. But he has a lot of work in store to write the full, substantiated appeal, and then present it in the court of appeals in person.

On September 22, the day after Russia announced a partial mobilization, sportsman and traveler Ilya Baburin was detained in Novosibirsk by FSB officers. He allegedly tried to organize the arson of the military registration and enlistment office.
Ilya is 23 years old, he worked in IT and was against Russia’s war agression in Ukraine from its very beginning.
Now he is being charged with several articles at once — "organization of a terrorist attack", "involvement in terrorist activities", and "treason".
On aggregate charges, Ilya faces an enormous sentence — from 15 years to life imprisonment.
However, the arson, which, according to the investigation, he organized, never happened.
Ilya did not admit guilt, and at the moment he refused to cooperate with the investigation or give any testimony.
In the pre-trial detention center he was humiliated by the administration.

Why are lawyers needed in Russia?
Sometimes you’ll hear people say that in modern Russia, it’s a waste of money to hire a lawyer for politically motivated cases. After all, they say, the person will be found guilty either way, and they’ll still get a sentence.
We’re here to explain why having a lawyer is vital for political prisoners in Russia.
First, a lawyer is the only person who is free to visit a prisoner in pre-trial detention and communicate with them without any censorship. Generally speaking, it is through lawyers that we hear about prisoners being tortured or otherwise pressured. And sometimes, if the prison administration blocks a prisoner’s correspondence, their defense lawyer becomes their only channel for communication with the outside world.
Second, the very fact of having hired a lawyer often serves as protection against torturing and other forms of pressure. After all, despite the Russian authorities’ high tolerance for torture, the security forces try to be secretive about the use of violence, and they strongly dislike receiving inspections from supervisory bodies. Once a person has a lawyer, it is no longer possible to torture them in secret.
Third, lawyers are the people who are always present when the accused goes through interrogations, investigations, and court hearings. That is, the lawyer is the only person who helps the accused actually confront the system, rather than leaving them to do it alone.
Fourth, a lawyer will always advise the accused to prevent them from worsening their situation during a testimony. After all, it is often on the basis of the defendant’s testimony that they are reclassified to more serious charges. Having a lawyer reduces the risk of aggravating those charges.
Fifth, despite the political situation in Russia, lawyers do continue, in some cases, to successfully reduce the scope of charges, the length of prison sentences, and sometimes even get their clients released. For example, Alexey Rozhkov and Andrei Bogdanov, who were accused of setting fire to military registration and enlistment offices, were released from pre-trial detention.
Sixth, it is up to the lawyer to ensure the trial gets publicity, by reporting on the case to independent media outlets. Otherwise, we are often left having to learn about anti-war cases from propaganda sources, which do their best to smear the defendants.
It is worth noting that we are talking only about bona fide lawyers who cooperate with human rights organizations, or simply have not lost their sense of conscience. Unfortunately, not all lawyers are like that: even a privately hired lawyer to whom you have paid money may not report your torture, and try to convince you to testify in a way that benefits the investigation.

18-year-old Mikhail Lazakovich from Tver, was detained on May 9 on suspicion of setting fire to a military recruitment center in Likhoslavl, 50 km away. On the advice of his appointed lawyer, the young man did not deny his involvement in the arson. However, instead of the promised mitigation of punishment, the charge was reclassified from "attempted damage to property" to "an act of terrorism".
After being charged under the "terrorist" article (Part 1 of Article 205 of the Russian Criminal Code), Mikhail refused to testify and plead guilty of terrorism.
"Mikhail is a serious, thoughtful young man who has his own opinion in life and defends it. He is a third-year student at an economics college on a part-time basis. He is fond of chess, art, and cooking. He has never been involved in fights, has never had a criminal record, and has never done anything illegal or anti-social. He is a very calm and peaceful person", says Lyubov, his mother.
The court sent Mikhail Lazakovich to the detention center. According to the charges, the young man faces from 10 to 20 years in prison. Solidarity zone found a lawyer, who has already started his work, providing legal assistance to Mikhail. We need 200 thousand rubles (€2300) to pay for the lawyer's work at the investigation stage.

On March 6, 2022 anti-war protests were held in Moscow. Vladimir Sergeyev and Anton Zhuchkov were stopped by police near the Pushkin Square. During the detention, Vladimir and Anton managed to take lethal doses of methadone — they were planning to commit a public suicide to protest Russia’s war aggression in Ukraine. At the hospital, the friends were saved, but then sent to the detention center.
On April 20, Vladimir Sergeyev was sentenced to 8 years in prison on charges of "preparation for a terrorist attack". It was deemed by the court and the investigation as the intention to set fire to an empty police van, which Sergeev stated while being detained (a bottle with incendiary mixture was found in his backpack). The defense does not consider this qualification of Sergeyev's actions reasonable.
Together with Vladimir's relatives, we launched a fundraiser to pay for a lawyer to appeal the verdict. However, only 24 thousand of the required 150 thousand rubles (€1700) have been collected so far.

We are raising a fund to appeal Igor Paskar’s sentence
On 31 May the Southern District military court sentenced Igor Paskar to eight-and-a-half years’ imprisonment, on charges of "terrorism" and "vandalism". That was how the court judged symbolically throwing a Molotov cocktail at a federal security services (FSB) building, and setting light to a Z-banner (a pro-war symbol) in Krasnodar. Igor undertook both of these actions to protest against the war: when he took the action at the FSB building, he painted the colours of the Ukrainian flag on his cheek.
The court defined Paskar’s action at the FSB building as an "act of terrorism", and ruled that the action had terrorised the population and posed a threat to people’s safety. The video recording of the action should be enough to convince you that it did no such thing.
Neither Igor Paskar nor his defence lawyer consider the sentence he has received to be justified.
We are raising a fund of €2400, to pay lawyers’ fees to appeal the sentence, and for transport expenses to Moscow for the appeal hearing.

At the end of May, Alexey Rozhkov was illegally extradited from Kyrgyzstan to Russia. Without observing the procedures under Kyrgyz law and international norms, officers from the Kyrgyz State Committee for National Security kidnapped Alexey and took him to the Russian Federation, where he was detained by FSB officers. The former threatened Alexei with torture, and the FSB put those threats into action — the young man told us that he had been tasered.
In Russia, a case has been opened against Rozhkov for committing arson in March 2022 on a military enlistment office in the suburbs of Yekaterinburg. After six months in pre-trial detention he was then released, and Alexey fled Russia, fearing a reclassification of the case to an act of terrorism.
After Alexey found himself back in a Russian pre-trial detention centre, the trial was resumed and the prosecutor requested that the case be remanded for further investigation.
The case is now under investigation for charges of property damage, but given recent trends there is a high risk of reclassification to a more serious article.
Solidarity zone has found a lawyer to defend Alexey and he has already begun working on the case. 150 thousand roubles (1577 Euros) is needed to pay for his work for the next stage.

Why was Igor Paskar sentenced to eight-and-a-half years?
We have written a few times about the facts of Igor Paskar’s case. He was sentenced to eight-and-a-half years’ imprisonment for throwing a firebomb at a Federal Security Services (FSB) office. You can see a video of his action. But how did the court treat this action? Why did it define it as a terrorist act?
In their decision to convict Igor Paskar, at the Southern District military court on 31 May this year, the three judges Kirill Krivtsov, Alexey Magamadov and Vladimir Tsybulnik described his motives as follows:
“Being discontented with the decisions and actions of organs of state power of the Russian Federation taken in relation to the conduct of the special military operation, from 24 February <...>, and wishing, in this regard, to express his negative attitude to the organs of state power of the Russian Federation, that is, motivated by political hostility”.
The judges actually painted a picture of a person who does not support Russian military aggression in Ukraine. No more, no less. But then they defined this as “political hostility”. And this “political hostility” is an aggravating circumstance, a more serious part of the decision.
The decision then describes how, on Russia Day (a national holiday), 12 June 2022, Paskar maliciously burned a banner “with a patriotic image in support of the special military operation, and the words ‘Z – We don’t abandon our own’”.

It was the symbolic fire-setting on the porch of the FSB offices at Krasnodar that the judges named a terrorist act. In their view, this small fire-show on the stone steps terrified the population and presented danger to life and limb — although from the video recording it is clear that no-one was fleeing in terror, and obvious to anyone with common sense that Paskar’s action presented absolutely no threat to anyone. No expert evidence was sought on this matter: the court simply took the word of the investigating officers.
The court further asserted that the fire was set with the aim of putting pressure on organs of state to stop the “special military operation”, as the authorities in Russia call the all-out war against Ukraine. But Igor never made any such demand, and explained that by his actions he had wanted only to draw attention to the war started by the Kremlin, and to express support for Ukrainian men and women resisting it.
In the light of the arguments we have made above, we do not consider Igor Paskar’s actions to have been terroristic. We do not think the formulation about “political hostility” is appropriate, either. For these reasons we consider the whole guilty verdict to be unlawful, baseless, and politically motivated. We demand the immediate release of Igor Paskar, and will especially pursue this demand if there is change in the political situation in the Russian Federation.
We also hope that Memorial, Amnesty International and other organisations will recognise Igor Paskar as a political prisoner.

We have written a few times about the facts of Igor Paskar’s case. He was sentenced to eight-and-a-half years’ imprisonment for throwing a firebomb at a Federal Security Services (FSB) office. You can see a video of his action. But how did the court treat this action? Why did it define it as a terrorist act?
In their decision to convict Igor Paskar, at the Southern District military court on 31 May this year, the three judges Kirill Krivtsov, Alexey Magamadov and Vladimir Tsybulnik described his motives as follows:
“Being discontented with the decisions and actions of organs of state power of the Russian Federation taken in relation to the conduct of the special military operation, from 24 February <...>, and wishing, in this regard, to express his negative attitude to the organs of state power of the Russian Federation, that is, motivated by political hostility”.
The judges actually painted a picture of a person who does not support Russian military aggression in Ukraine. No more, no less. But then they defined this as “political hostility”. And this “political hostility” is an aggravating circumstance, a more serious part of the decision.
The decision then describes how, on Russia Day (a national holiday), 12 June 2022, Paskar maliciously burned a banner “with a patriotic image in support of the special military operation, and the words ‘Z – We don’t abandon our own’”.

We are announcing a fundraiser for Mikhail Lazakovich
His previous lawyer turned out to be a scummer
On May 9, 2023, law enforcers detained 18-year-old Mikhail Lazakovich on suspicion of arson at a military recruitment center in Likhoslavl, Tver region.
On the advice of the appointed state lawyer, the young man did not deny involvement in the arson, but instead of mitigating the charge, it was reclassified from "attempted property damage" to "committing a terrorist act". Mikhail now faces 10 to 20 years in prison.
Solidarity zone began to support Mikhail and quickly found a lawyer for him, Maxim Ovchinnikov, making a contract with him for the period of the investigation with the payment of 200,000 rubles.
Within two months, Solidarity zone paid the agreed amount to the lawyer Maxim Ovchinnikov in full.
However, at the end of July we learned from Mikhail's mother that lawyer Ovchinnikov demands from her an additional payment of 100 thousand rubles for each subsequent month, because the 200 thousand rubles already paid by us allegedly covered only the first 2 months of work. This contradicts the contract signed with the Solidarity zone, which settled a a condition of single payment for the "period of preliminary investigation", not monthly.
It also turned out that Mikhail's mother had to pay 30 thousand rubles for each trip of the lawyer from Moscow to Tver (the total amount already came to 120 thousand rubles). At the same time, lawyer Ovchinnikov did not ask us to pay for additional trips and concealed that he was taking money from Lazakovich's mother.
In a conversation with Solidarity zone, Ovchinnikov's lawyer referred to a contract made with Lazakovich's mother. On the first day after Mikhail's detention, his mom did sign some kind of agreement with Ovchinnikov right on the way to court, but she did not receive a copy of this document. Later, a contract for Lazakovich's defense was signed with Solidarity zone, which should cancel any other similar contracts. At the same time, lawyer Ovchinnikov refused to send a copy of the contract previously made with Mikhail's mother.
Lawyer Ovchinnikov did not give a coherent answer to any of our questions about how this situation could have arisen in the first place. We were forced to stop cooperating with him and find another lawyer for Mikhail.
In August we found a new lawyer, and got Lazakovic's consent to this change.
Due to this situation we are forced to reopen the collection of funds to pay for a lawyer for Mikhail Lazakovich.
Now we need to raise 250 thousand rubles (€2400) for the defense of Mikhail Lazakovich at the stages of investigation and in the courts of first instance. The situation is financially difficult and we need your support.

New fundraiser to pay for Ivan Kudryashov’s cassation court lawyer
Ivan Kudryashov is an anti-war activist from Tver. He was sentenced to 6 years in prison for allegedly preparing to set fire to a military recruitment centre under criminal articles regarding "preparation for a terrorist act" (article 30 part 1, article 205 part 1 of the Criminal Code of the Russian Federation). The military appeals court later reduced this sentence to 4 years and 10 months.
Ivan is the artist behind the resonant “Fuck the War” street art in Tver, as well as a number of other actions, some even before 2022. The young man did not hide his anti-war stance and proved a convenient target to fabricate a criminal case around.
Why do we believe the case was entirely fabricated?
🔻 The court did not take into account that the testimony was given under duress (this was not even investigated).
🔻 The fact of "intimidating of the population", which is used in the case against him, was never established. The court indicates that Kudryashov wanted to disrupt mobilisation, which is a completely different motive.
🔻 No witnesses were called to the hearings.
🔻 There is no evidence of the fact of the crime, nor preparation for it, in the case file. For example, there is no evidence that Kudryashov was planning to set something on fire; Ivan's fingerprints are not present on the bottles of flammable mixture; the hair found does not belong to him either; and the operatives could not explain how they got the information about the presence of Molotov cocktails before carrying out a search.
Solidarity zone is opening a new fundraiser for a defence lawyer in cassation court. The defence lawyer also believes that the case is completely fabricated, and that the young man should be released immediately!

We are launching a fund for the legal defence of Mikhail Balabanov. We need to raise €4600
Twenty-year-old Mikhail Balabanov was detained almost a year ago. The FSB accused him of preparing to firebomb the military recruitment center at Nevinnomyssk. We consider the case against Balabanov to be a provocation by the Russian security services.
The investigating officers claim that Balabanov entered a conspiracy with a representative of Ukrainian intelligence services. And indeed, Mikhail was contacted by someone with the codename “Ben”, claiming to be a GUR [Ukrainian intelligence] operative. Mikhail wanted to avoid being conscripted, and “Ben” promised to arrange this, but in return asked Balabanov to undertake a number of “tasks”. These included making a video recording of conscripts, and of military equipment at the recruitment center’s premises.
When Mikhail arrived at the recruitment center, the security services were waiting there for him. Subsequently, during a search of his home, they “found” a Molotov cocktail. Balabanov has been accused of “preparation of a terrorist act”, and faces the threat of 10 years’ imprisonment.
We believe that it was FSB officers who were corresponding with Mikhail, taking advantage of the fact that he did not want to take part in the attack on Ukraine.

Yury Mikheev, aged 18, was arrested together with Matvei Mel'nikov on November 10 on the territory of military section in the Moscow region. The FSB accused the young men of preparing arson on military equipment, including a 40V6 universal mobile mast, which is a component of the S-300 surface-to-air missile system.
Yury Mikheev was charged with preparing an act of sabotage, and was sent to a pre-trial detention centre. The young man is threatened with a custodial sentence of up to 10 years.
Yury Mikheev is an antifascist, who does not support Russian aggression against Ukraine. Yura became friends with Matvei Mel'nikov, who, like him, came out against the war. We still don't know the full details of the case, but it seems very likely that this was a provocation by the special services, who corresponded with Mel'nikov, pretending to be partisans.
Yury's friend says: "He's just a great guy: he always supports and helps everyone. He's the kind of person who will never let anyone down, whatever happens. He's such a brilliant, interesting and friendly person. I sometimes don't even know how all these qualities can be combined in one person. And I'm proud that he's my friend".

Anti-war activist Aleksei Rozhkov needs our help. Support the fundraiser!
Aleksei is accused of committing arson on a military recruitment office in a suburb of Ekaterinburg in March 2022. He was the third person in Russia to take this form of protest against the full-scale invasion of Ukraine.
Not long ago Aleksei was living in freedom and not even in Russia. However, in late May of this year, security agents illegally kidnapped Rozhkov in Kyrgyzstan and brought him to Russia, where the FSB tortured him.
In October, Rozhkov's situation significantly worsened: he was charged with committing an "act of terrorism". A case was also brought against Aleksei with a charge of "public defence of terrorism" for his video "The man who set fire to a military recruitment office: there can be no peace for Putinist fascism". Aleksei is now threatened with 10 to 22 years in prison.
Aleksei pleads innocence to the new accusations.
Rozhkov calls himself an anarchist, and before the full-scale invasion also took part in activism: he flyposted and he graffitied critiques of the authorities. Before his first arrest, Aleksei worked as a sales assistant in a electronics shop, enjoyed music and played bass in the group "Tell me the reason".
Due to the increasing seriousness of the case, Solidarity zone is starting a new fundraiser to pay for the work of a lawyer and for a review of the psychological-linguistic expertise used to "detect" evidence of "public defence of terrorism" in the video. The review could help have this charge removed for Rozhkov.

Fund-raiser for the anarchist Ruslan Siddiqui
The anarchist Ruslan Siddiqui is accused of causing an explosion, on a railway used to transport military equipment and fuel to the Russian army in Ukraine. The result was the derailment of 19 carriages of a goods train. There were no casualties, although the driver’s assistant sustained non-serious injuries. Russian Railways assessed the damage at €300.000.
Ruslan has been charged with committing a terrorist act, and possession of explosive material. He is faced with between 12 and 30 years’ imprisonment.
Ruslan’s comrades say: "Ruslan is a proponent of anarchist ideas, and the Russian military aggression against Ukraine distressed him greatly. All the more so because some of his friends and comrades died in that conflict, and people continue to die there".
Ruslan does not deny that he organized an act of sabotage. He drew attention to a stretch of railway along which military equipment and fuel is often transported to the front. Ruslan set out, on purpose, to damage the track under a goods train, to avoid casualties. He monitored progress using a video camera.
Ruslan’s motive was completely opposite to terrorism. Siddiqui has repeatedly stated that his action was, on the contrary, aimed at preventing deaths and injuries. He insists that his objective was to damage the infrastructure for the delivery of goods.
Ruslan states categorically his opposition to damaging civilian infrastructure, and all the more to attacking peaceful civilians.
We remain convinced that every single person who takes action against Russian military aggression is worthy of defence and solidarity.
Legal defence is especially important to those accused of "terrorism": we have learned in practice that, in these cases, the security services often use torture and other methods of intimidation. Moreover, the prison sentences for "terrorist" offences are significantly longer than for others.

🥳 We have collected €4200 for Yury Mikheev’s defence
In December we announced a fundraiser to cover six months’ work by a defence lawyer for the antifascist Yury Mikheev, who has been accused by the Federal Security Service (FSB) of preparing an act of sabotage. The prosecution claims that Mikheev and a friend planned to set fire to equipment at a military base in the Moscow region.
Thanks to the many people who gave solidarity donations, we today reached our €4200 target! We are very grateful to all who sent funds, reposted information and spread the word about Mikheev’s case and our fundraiser.
For the coming months, Yury is assured of the defence, support and professional consultation of an experienced lawyer. We have already written here about why this is so important, even under conditions of the most brutal dictatorship.
